IMPORTANT NOTICE - PLEASE READ BEFORE YOU ACCEPT.
THIS AGREEMENT CONTAINS AN ASSUMPTION OF RISK, A RELEASE OF LIABILITY THAT COVERS THE ORDINARY NEGLIGENCE OF DRIFT GOLF + SOCIAL CLUB, AN OBLIGATION TO INDEMNIFY THE CLUB, A BINDING ARBITRATION PROVISION, AND WAIVERS OF YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. IT ALSO EXPLAINS WHEN DUES ARE AND ARE NOT REFUNDABLE.
THIS RELEASE DOES NOT APPLY TO GROSS NEGLIGENCE OR INTENTIONAL MISCONDUCT, AND NOTHING IN THIS AGREEMENT WAIVES ANY RIGHT THAT CANNOT BE WAIVED UNDER TEXAS LAW.
DO NOT ACCEPT THESE TERMS UNTIL YOU HAVE READ THEM. IF YOU DO NOT AGREE, DO NOT CLICK "I AGREE," DO NOT PURCHASE A MEMBERSHIP, AND DO NOT USE THE FACILITY AS A MEMBER.
1. DEFINITIONS
In this Agreement, the following terms have the meanings given below.
"Agreement," "Terms," or "Terms & Conditions" means these Terms & Conditions, together with Schedule A (Fee Schedule) and Schedule B (House Rules). These words are used interchangeably throughout.
"Club," "Drift," "we," "us," or "our" means Drift Golf + Social, LLC, a Texas limited liability company doing business as Drift Golf + Social Club, together with its members, managers, officers, employees, contractors, agents, affiliates, successors, and assigns.
"Facility" or "Premises" means the Drift Golf + Social Club building and grounds located at 10020 Darden Hill Rd, Building 10, Austin, Hays County, Texas, 78737, including the simulator bays, bar, retail area, mezzanine and event space, dart lanes, game room, restrooms, storage areas, parking, and any outdoor areas under the Club's control.
"Member," "you," or "your" means an individual whose membership application has been accepted by the Club and whose membership is in good standing.
"Guest" means any person who enters the Facility at the invitation of, or accompanied by, a Member, and who is not themselves a Member.
"Released Parties" means the Club, Linds and Dylan LLC series DBP, 10, and each of their respective members, managers, officers, employees, contractors, agents, affiliates, successors, and assigns, collectively.
"Governing Documents" means this Agreement together with the Member Handbook, the Club Code of Conduct, the Fee Schedule, the Privacy Policy, and any House Rules posted at the Facility or published by the Club, each as amended from time to time in accordance with Section 37.
"Payment Method" means the credit card, debit card, or bank account you authorize the Club to charge for dues and other amounts owed.
"Dues" means the recurring membership fee applicable to your membership category, as set out in the Fee Schedule. For Founders Circle Members, the Founders Circle Membership Fee, initial Membership Term, and absence of recurring Dues during the initial Membership Term are governed by the Founders Circle Membership Addendum.
2. ACCEPTANCE OF THESE TERMS
These Terms are a binding contract between you and Drift Golf + Social, LLC. You accept them by clicking "I Agree" (or a similarly labeled button), by purchasing a membership, by creating a member account, or by using the Facility as a Member - whichever happens first. If you do not agree to these Terms, do not accept them and do not purchase a membership.
Clicking "I Agree" is your signature. Clicking an acceptance button, checking an acceptance box, or submitting a digital membership form constitutes a valid and binding electronic signature under the Texas Uniform Electronic Transactions Act, Texas Business & Commerce Code Chapter 322, and the federal E-SIGN Act, 15 U.S.C. § 7001 et seq. It has the same legal effect as a handwritten signature. No printed or handwritten signature is required.
Record of your acceptance: The Club records the date and time you accept, the account name and email address used, the membership category selected, and the version of these Terms in effect at that moment. That record is the Club's evidence of your agreement, and you agree it may be used as evidence in any legal or arbitration proceeding. On request, the Club will provide you a copy of the version you accepted.
Who may accept: You must accept these Terms under your own account. One person may not accept on behalf of another adult. If you accept on behalf of a company or organization, you represent that you have authority to bind it, and "you" refers to both you and that organization.
3. NATURE OF MEMBERSHIP
Membership at Drift is a revocable license to use the Facility and its amenities in accordance with the Governing Documents. It is a contractual privilege only.
Membership does not create any ownership interest, equity interest, proprietary right, or voting right in the Club, the entity that operates it, the real property, or any Club asset. Members have no right to any distribution of Club revenue or assets, no right to participate in Club management, and no interest in the Club upon its sale, dissolution, or closure.
Membership is personal to you. It may not be sold, assigned, transferred, loaned, or shared, and access credentials may not be given to any other person, except as expressly permitted for Founders Circle Memberships under Section 13 or for Business memberships under Section 5.
4. ELIGIBILITY AND ADMISSION
You must be at least twenty-one (21) years of age to hold a membership and to enter into this Agreement. Membership is subject to Club approval, and the Club may decline any application in its discretion for any lawful reason. Membership may be capped by category, and applicants may be placed on a waitlist.
You agree to provide accurate information on your membership application, including a current mailing address, email address, and phone number, and to keep that information current. Providing materially false information is grounds for termination of membership.
5. MEMBERSHIP CATEGORIES AND BENEFITS
The Club offers the membership categories described in the Fee Schedule (Schedule A). Categories, rates, inclusions, and any usage caps are set out there and may be adjusted under Section 37. As of the Effective Date, the categories are:
Founders Circle Members - limited to twenty (20) memberships, with the additional terms in Section 13.
Signature Member - Unlimited Off-Peak (2-hour max per session), plus 5 Peak Hours per month; book up to 14 days in advance; hold up to 2 active bookings. Golf leagues and tournaments; quarterly member-only events; 20% off additional bay time; complimentary Drift hat; quarterly events, tournaments, themed member nights, annual PGA major events.
Local Member - 8 hours per month (2-hour max per session); book up to 7 days in advance; hold 1 active booking. Golf leagues and tournaments; quarterly member-only social events; 10% off additional bay time; complimentary Drift hat; quarterly events, tournaments, themed member nights, annual PGA major events.
Signature Business Member - Available to a company or organization, covering up to 5 designated individuals. Unlimited off-peak for all members; 15 pooled peak hours per month shared across the membership (2-hour max per session). Designated individuals must each be named in writing, must each accept these Terms under their own account, and may be substituted no more than 2 times per year. Quarterly events, tournaments, themed member nights, annual PGA major events. Hold up to 4 active bookings (14-day window).
Local Business Member - Available to a company or organization, covering up to 5 designated individuals. 25 pooled hours per month shared across the membership (2-hour max per session). Designated individuals must each be named in writing, must each accept these Terms under their own account, and may be substituted no more than 2 times per year. Quarterly events, tournaments, themed member nights, annual PGA major events. Hold up to 3 active bookings (7-day window).
Board Member - Full club and dart access, 5:00 a.m.-12:00 a.m.; access to dart leagues and tournaments; access to golf leagues and tournaments; one simulator hour per month; 20% off public tee times; and quarterly member-only social events.
"Peak Hours" means: Monday-Friday 4:00 p.m.-12:00 a.m.; Saturday-Sunday 5:00 a.m.-12:00 a.m., as posted at the Facility and published by the Club. The Club may adjust Peak Hours seasonally on thirty (30) days' notice.
"Off-Peak Hours" means: Monday-Friday 5:00 a.m.-4:00 p.m.
Unused hours. Unless the Fee Schedule states otherwise, monthly simulator hours do not roll over and expire at the end of each billing cycle. Unused hours have no cash value and are not refundable.
6. TERM AND AUTOMATIC RENEWAL
Except as otherwise expressly provided in a membership-specific agreement or addendum, your membership begins on the date the Club accepts your application and your initiation fee is processed, and continues for the initial term stated in your membership selection: month-to-month or twelve (12) months. Founders Circle Memberships are governed by the commencement and twenty-four (24) month term provisions of the Founders Circle Membership Addendum.
EXCEPT AS OTHERWISE EXPRESSLY PROVIDED IN A MEMBERSHIP-SPECIFIC AGREEMENT OR ADDENDUM, YOUR MEMBERSHIP RENEWS AUTOMATICALLY. MONTH-TO-MONTH MEMBERSHIPS RENEW EACH MONTH, AND ANNUAL MEMBERSHIPS RENEW FOR SUCCESSIVE TWELVE (12) MONTH TERMS, IN EACH CASE AT THE THEN-CURRENT RATE FOR YOUR CATEGORY, UNTIL YOU CANCEL UNDER SECTION 10.
7. DUES, FEES, AND BILLING AUTHORIZATION
You agree to pay the Dues and any other fees applicable to your membership, plus all applicable taxes, as set out in the Fee Schedule. Billing authorization permits the Club to charge your Payment Method on each billing date for Dues and accrued charges without obtaining separate authorization for each charge.
8. DECLINED PAYMENTS, LATE CHARGES, AND COLLECTIONS
If a payment is declined or returned, the Club will notify you and may attempt to collect again. A returned or rejected payment fee of $30.00 may be charged for each declined or returned payment. Past due balances will receive a 15% Past Due fee; if unresolved within 30 days the account will be terminated.
9. BILLING QUESTIONS AND DISPUTES
If you believe a charge is incorrect, contact the Club at membership@driftgolfsocial.com within sixty (60) days of the charge. We ask that you contact us before disputing a charge with your card issuer.
10. CANCELLATION BY MEMBER
Month-to-month memberships: with fourteen (14) days' notice before your next billing date.
Annual memberships: at any time, effective at the end of the current twelve (12) month term, by giving notice at least thirty (30) days before the renewal date.
11. REFUNDS
Dues already paid for a current billing cycle are not refunded. Initiation fees and event deposits are non-refundable unless stated otherwise. If you cancel an annual membership mid-term, an account credit for the unused balance will be issued, valid for 12 months.
12. MEMBERSHIP HOLDS
A Member in good standing may place their membership on hold for medical reasons, military deployment, or extended travel, for 1 to 3 months in any 12-month period. Dues are reduced to $0 per month during a hold.
13. FOUNDERS CIRCLE MEMBERS
Founders Circle Memberships are governed by the Founders Circle Membership Addendum, which controls as to Founders Circle-specific terms.
14. BAY RESERVATIONS, CANCELLATIONS, AND NO-SHOWS
Cancel or change a reservation at least twelve (12) hours before the start time to avoid a fee. Late cancellations or no-shows may be charged against your monthly hour allowance, or billed at 50% of the hourly rate if no hours remain. Overstay charges of $15 per 15 minutes may apply.
15. HOURS AND ACCESS
Facility hours are posted at the Facility. Credentials are personal to you; sharing a credential or admitting an un-checked guest carries a $50 fee, suspension, or termination.
16. GUEST PRIVILEGES
Members may bring up to 3 Guests per visit. Adult Guests must check in and sign the Guest Waiver. Sponsoring Members must remain present with their Guests at all times.
17. MINORS AND FAMILY ACCESS
Minors under 18 must be directly supervised by a parent or authorized adult at all times. Persons under 18 may not remain in the Facility after 11 p.m. without supervision. No person under 21 may consume alcohol under any circumstance.
18. ALCOHOL POLICY
All alcohol must be purchased from and served by Club staff; outside alcohol is strictly prohibited. Valid ID is required for all purchases. Staff reserve the right to refuse service to anyone who appears intoxicated.
19. OUTSIDE FOOD AND BEVERAGE
Outside food requires advance Club approval. Outside alcohol is strictly forbidden at all times.
20. PRIVATE EVENTS AND THE MEZZANINE
Private events are governed under separate agreements. Alcohol is strictly served by Club staff.
21. DART LANES, GAME ROOM, AND OTHER AMENITIES
Equipment must be used only in designated areas for its intended purpose. Throwing or swinging objects outside designated areas is prohibited.
22. INSTRUCTION, LESSONS, AND CLINICS
Lessons must be cancelled 24 hours in advance. Packages expire 12 months after purchase.
23. MERCHANDISE AND PRO SHOP
Members receive 20% off Drift-branded merchandise. Unworn items with tags can be returned within 7 days.
24. FACILITY AND SAFETY RULES
Swing only from designated mats. Only one person in the hitting area at a time. Metal spikes and bare feet are prohibited. Indoor smoking and vaping are strictly forbidden.
25. MEMBER CONDUCT AND CLUB STANDARDS
Harassment, discrimination, threats, abusive treatment, property damage, and disruptive intoxication will not be tolerated. Commercial business activities on the Premises without written approval are prohibited.
26. PERSONAL PROPERTY
The Club is not responsible for lost, stolen, or damaged personal belongings. Found items are held for 30 days before disposal.
27. DAMAGE TO CLUB PROPERTY
Members are liable for damage caused by themselves or their Guests beyond normal wear. Charges include repair costs, a $150 administrative fee, and lost revenue.
28. SUSPENSION AND TERMINATION BY THE CLUB
The Club may immediately suspend or terminate access for Cause (violence, harassment, property damage, safety violations, false info). For minor violations, a 7-day cure notice is provided.
29. ASSUMPTION OF RISK
YOU VOLUNTARILY ACCEPT ALL INHERENT RISKS OF GOLF, DARTS, AND FACILITY USE, INCLUDING BEING STRUCK BY BALLS OR CLUBS, SLIPS/FALLS, AND MALFUNCTIONS.
30. RELEASE OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW, YOU RELEASE DRIFT GOLF + SOCIAL CLUB FROM CLAIMS ARISING FROM ORDINARY NEGLIGENCE.
31. INDEMNIFICATION
YOU AGREE TO DEFEND AND HOLD HARMLESS THE CLUB AGAINST CLAIMS ARISING FROM YOUR ACTS, YOUR GUESTS' ACTS, MINOR SUPERVISION FAILURES, OR PROPERTY DAMAGE.
32. LIMITATION OF LIABILITY
LIABILITY FOR NON-PERSONAL INJURY CLAIMS IS LIMITED TO DUES PAID IN THE PRECEDING 12 MONTHS.
33. PHOTOGRAPHY, VIDEO, AND MEDIA
You grant the Club permission to use your image for marketing; opt-outs can be submitted in writing.
34. VIDEO SURVEILLANCE AND CLUB RECORDS
Common areas are under 24/7 video surveillance for safety and security.
35. PRIVACY
Data is collected and used strictly as outlined in the Club's Privacy Policy.
36. FORCE MAJEURE AND SERVICE INTERRUPTIONS
Pro-rata credits apply if the Facility is closed for over 14 consecutive days.
37. CHANGES TO DUES, BENEFITS, AND RULES
30 days' written notice will be given for Dues increases or material benefit reductions.
38. DISPUTE RESOLUTION
BINDING ARBITRATION UNDER THE FAA IN HAYS COUNTY, TEXAS. CLASS ACTION WAIVER AND JURY TRIAL WAIVER APPLY.
39. GOVERNING LAW AND VENUE
Governed by Texas state laws, with venue in Hays County, Texas.
40. NOTICES

41. INTELLECTUAL PROPERTY
All brand logos, names, and content belong exclusively to the Club.
42. GENERAL PROVISIONS
Includes standard provisions regarding severability, survival, non-waiver, and full agreement.
43. ACKNOWLEDGMENT AT ACCEPTANCE
BY CLICKING "I AGREE," YOU CONFIRM YOU ARE 21+, HAVE READ THESE TERMS IN FULL, AND ACCEPT THEM VOLUNTARILY.

SCHEDULE B | HOUSE RULES
- Love thy neighbor - the club is a gathering space for community members. Be respectful always.
- Check in every visit. Check in every guest. No exceptions.
- Swing only in a bay, from the mat. One person in the hitting area at a time.
- No outside alcohol. All alcohol is purchased from and served by Club staff. 21+ with valid ID.
- Minors must be supervised by an adult in the Facility at all times.
- Do not adjust or touch simulator equipment. Report problems to staff.
- No metal spikes. No bare feet. Appropriate attire.
- No smoking or vaping indoors.
- Cancel bay reservations at least twelve hours out. Be on time. Wrap up on time.
- Treat staff, members, and guests the way you would want your family treated.
- Clean up after yourself and your group. Return equipment where you found it.
